I. Privacy Policy

Overview
Member's and/or Merchant's privacy is very important to TrumerX. In compliance with the local Personal Data Protection Act 2010, every Member's and/or Merchant's personal information in TrumerX's database will be safeguarded and will not be shared without Member's and/or Merchant's consent.

As part of the normal operation of TrumerX's services, TrumerX collects and, in some cases, disclose Member's and/or Merchant's information, if and when needed. This Privacy Policy describes the information TrumerX collects about Member and/or Merchant and what may happen to that information. Although this policy may seem lengthy, TrumerX has prepared a detailed policy because Members and/or Merchants should be informed as much as possible about TrumerX's practices, allowing Members and/or Merchants to make an informed decision.

By using TrumerX, Members and/or Merchants signify their assent to TrumerX's Privacy Policy. Changes to the Privacy Policy are effective after the posting of such changes on the announcement board. Any such change shall be effective after 10 Business Days, following the initial posting of any changes. Member's and/or Merchant's continued use of TrumerX, following the notification of changes to the Privacy Policy will mean that Members and/or Merchants accept those changes.

As described below, some of the Member's and/or Merchant's personally identifiable information is disclosed to third parties and used by third parties and TrumerX. By accepting the TrumerX Client Agreement, Members and/or Merchants expressly consent to TrumerX's use and disclosure of Member's and/or Merchant's personally identifiable information as set forth in this policy. This Privacy Policy is incorporated into and subject to the terms of the TrumerX Client Agreement.

  1. Information that TrumerX Collects
    TrumerX will explicitly ask when in need of information that identifies Member's and/or Merchant's business or allows TrumerX or other participating Members and/or Merchants to contact other Members and/or Merchants ("Your Information"). Generally this information is requested during the online registration.
  1. TrumerX's Use of Member's and/or Merchant's Information
    2.1 TrumerX uses personally identifiable information about Member and/or Merchant to improve marketing and promotional efforts, to statistically analyse site usage, to improve TrumerX content and product offerings and to customise TrumerX's website's content, layout, and services. TrumerX believes that these uses will allow further improvement to better suit all Member's and/or Merchant's needs.
    2.2 TrumerX shall use Member's and/or Merchant's email address, mailing address, and phone number to contact Members and/or Merchants regarding administrative notices, new product offerings, and any other communications relevant to Member's and/or Merchant's use of TrumerX. If Members and/or Merchants do not wish to receive these communications, Members and/or Merchants will have the ability to opt out.
    2.3 If Member and/or Merchant chooses to conduct trades on TrumerX or open a credit account, TrumerX will use Member's and/or Merchant's address and billing information to bill Member and/or Merchant and provide associated support.
    2.4 TrumerX will use information in the file created for Members and/or Merchants, and other information obtained from Member's and/or Merchant's current and past activities on TrumerX, to resolve disputes, troubleshoot problems and enforce the Client Agreement. At times, TrumerX may look across multiple Members and/or Merchants to identify problems or resolve disputes, and in particular, on rare occasions, may evaluate Member's and/or Merchant's information to look for Members and/or Merchants using multiple TrumerX identification card numbers or aliases.
    2.5 TrumerX will use Member's and/or Merchant's information to assess Member's and/or Merchant's credit worthiness.
  1. TrumerX Disclosure of Member's and/or Merchant's Information
    3.1 As a general practice, TrumerX does not sell or rent any personally identifiable information about Members and/or Merchants to any third party. The following describes some of the ways that Member's and/or Merchant's personally identifiable information may be disclosed.
    3.2 TrumerX. Throughout the website (www.TrumerX.com), Members and/or Merchants can search and view information on other Members and/or Merchants, including business name, contact name and contact information. As a result, other Members and/or Merchants and third parties might send unsolicited correspondence and be able to identify activities on the website (www.TrumerX.com). TrumerX also provides a number of ways to find out more about Members and/or Merchants and their site activities, such as viewing all of the goods and services offered at the time.
    3.3 Legal Requests. The Company cooperates with law enforcement inquiries and other third parties to enforce laws, intellectual property and other rights, therefore, intellectual property and other rights owners, and local, state, federal and international law enforcement can request and may receive Member's and/or Merchant's personally identifiable information.
    3.4 Credit Reporting Agencies. TrumerX may disclose Member's and/or Merchant's information to credit reporting agencies.
    3.5 Due to the regulatory environment, TrumerX cannot ensure that all Member's and/or Merchant's private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), TrumerX may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. TrumerX can (with Member's and/or Merchant's authorization) disclose any information about Members and/or Merchants to law enforcements or other government officials as TrumerX, in sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose TrumerX to legal liability. Furthermore, TrumerX can (with Member's and/or Merchant's authorisation) disclose Member's and/or Merchant's name, street address, city, state, post code, country, phone number, email, and company information in absolute sole discretion believe is necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. Therefore, although TrumerX uses industry standard practices to protect Member's and/or Merchant's privacy, TrumerX does not promise, and Member's and/or Merchant's should not expect, their personally identifiable information or private communications would remain private.
  1. Members' and/or Merchants' Use of Other Members' and/or Merchants' Information
    4.1 In order to facilitate interaction among all Members and/or Merchants, TrumerX's service allows Members and/or Merchants to access other Members and/or Merchants' contact information. Furthermore, as a seller, Members and/or Merchants will be sent the TrumerX account number, email address and other information of the interested buyer(s) via email or by other online means, and as a buyer, Members and/or Merchants will be sent the TrumerX account number, email address and other information of the seller via email.
    4.2 By entering into the TrumerX Client Agreement, Members and/or Merchants agree that, with respect to other Member's and/or Merchant's personally identifiable information obtained through TrumerX or through a TrumerX-related communication or TrumerX-facilitated transaction, Member and/or Merchant may use such information only for: (a) TrumerX-related communications that are not unsolicited commercial messages, and (b) any other purpose to which such Member and/or Merchant expressly consents after adequate disclosure of the purpose(s). In all cases, Members and/or Merchants must give other Members and/or Merchants an opportunity to remove themselves from database and a chance to review what information has been collected about them. In addition, under no circumstances, except as defined in this section, can a Member and/or Merchant disclose personally identifiable information about another Member and/or Merchant to any third party without TrumerX's consent and the consent of such other Member and/or Merchant after adequate disclosure.
    4.3 TrumerX and its Members and/or Merchants do not tolerate spam. Therefore, without limiting the foregoing, Members and/or Merchants may not add another TrumerX Member and/or Merchant (even a Member and/or Merchant who has made purchases from another Member and/or Merchant) to the mailing list (email or physical mail) without that Member's and/or Merchant's express consent after adequate disclosure.
  1. Control of Members' and/or Merchants' Personal Identification Number (PIN)
    5.1 Members and/or Merchants may not disclose or share the TrumerX PIN (also known as "password") to, or with any third parties. If a Member and/or Merchant loses control of their PIN, the Member and/or Merchant may lose substantial control over the personally identifiable information and may be subject to legally binding actions taken on their behalf. If Member's and/or Merchant's PIN has been compromised for any reason, Member and/or Merchant should take immediate action of changing the PIN.
  1. Reviewing and Changing Member's and/or Merchant's Information
    6.1 Following the registration, Member and/or Merchant can review and may be able to change the information submitted during registration including:
    • Name, company, registration number, address, city, state, post code, country, phone number, fax number
    • PIN
    6.2 Member and/or Merchant is expected to promptly update information if it changes.
    6.3 In responding to a request to have the personally identifiable information removed from TrumerX's databases, Member and/or Merchant should not expect that all information would be completely removed. In some circumstances, TrumerX will maintain the information in order to resolve disputes, troubleshoot problems and enforce the Client Agreement. Furthermore, technical constraints (related to database architecture and programming) prevent TrumerX from completely removing such information.
  1. Other Information Collectors
    7.1 As otherwise expressly discussed in this Privacy Policy, this document only addresses the use and disclosure of information that TrumerX collects from Members and/or Merchants. To the extent that Member and/or Merchant disclose their information to other parties, whether they are buyers or sellers on the TrumerX system, different rules may apply to the use or disclosure of the personal information disclosed to them. Since TrumerX does not control the privacy policies of third parties, Members and/or Merchants are subjected to the privacy customs and policies of that third party. TrumerX encourage Member and/or Merchant to ask questions before disclosing personal information to others.
  1. Security
    8.1 TrumerX uses industry standard efforts to safeguard the confidentiality of Members and/or Merchants' personal identifiable information, such as firewalls and Secure Socket Layers. However, "perfect security" does not exist on the Internet.

II. Transaction Fees And Policy

Fees will be payable in the form of cash in local currency (denoted as RM) and/or TRM (the TrumerX term for "TRM"), where applicable.

    The cash fee amount will be reflected in the monthly statement of account and is due 15 days from the statement date.
     
    The above cash fees are currently waived until further notice.

  • Transaction Fees and Policy For RM Transactions
  • RM is used to record the value of goods and services transacted in the local currency between the buyer and seller. The value of the local currency is as per the table 'RM and Value of Local Currency' as determined and displayed by TrumerX at the time of the transaction.The numerical value of TRM is determined by the similar numerical value of RM. The buyer will not be subjected to any fees. The policy of crediting and paying the seller shall be:

      Selling Trumer Merchant
      TRM to be credited to Trumer Merchant: 17%
      RM to be credited to Trumer Merchant: 80%


      Selling Trumer Member
      TRM to be credited to Trumer Member: 7%
      RM to be credited to Trumer Member: 90%

    When RM is transacted, the amount of local currency paid by the buyer as received by TrumerX and the equivalent RM, less fees or charges due to TrumerX from any Member and/or Merchant in accordance with the terms and conditions of this Agreement, is credited to the seller as a pending RM balance. This pending balance cannot be used for any transactions within TrumerX. The pending RM balance will then be credited to the bank account of the seller in the local currency within the stipulated time given in this Agreement by TrumerX and the equivalent amount of the local currency to be credited to the bank account will be as determined and displayed by TrumerX as per the table 'RM and Value of Local Currency' at the time of the transaction.

  •   A processing fee of RM500.00 is payable upon registration. The processing fee is currently waived until further notice.
     

    Notwithstanding the Transaction Fees And Policy stated in II above, the Current TrumerX Programs stated in VII below shall be applicable and effective after 10 Business Days once it is posted on the TrumerX website.

    III. Settlement Policy

    Should a transaction be concluded in part TRM and part RM, the respective cash and TRM amount will be settled by Member and/or Merchant within 14 days of the transaction.

    IV. Inventory Policy

    To help Members and/or Merchants list products and services accordingly, TrumerX have highlighted some inventory policies and described how TrumerX handles inventory violations when it is reported.

    Pricing
    Inventory items listed on TrumerX must be priced in RM and/or TRM. The value of TRM1.00 is equivalent to the value of the local currency denoted as RM1.00, as determined by TrumerX. All goods and services shall be listed for sale at the RM and or TRM price equal to the Member's and/or Merchant's prevailing cash price (e.g. an item that normally sells for RM99.95 cash must be listed as TRM/RM99.95 on TrumerX). The maximum TRM accepted as listed on TrumerX shall not be changed after the transaction has been authorized.

    Transactions via TrumerX uses RM and/or TRM
    TrumerX's Members and/or Merchants can only use RM and/or TRM when trading products and/or services via the website (www.trumerX.com) or TrumerX apps.

    Proper Inventory Category
    Inventory must be listed in the appropriate category. Inventory that doesn't belong in a category will be moved to the appropriate category.

    Keyword Spamming
    Inventory that includes unrelated key word terms used in effort to gain unfair exposure for seller's inventory is not permitted and will be deleted.

    Links
    Members and/or Merchants may place a simple link to another web page in the description portion of their inventory to help provide more information about the listed item. However, the following links are not permitted:

    1. Links to sites offering merchandise are prohibited on the TrumerX website.
    2. Links to other online trade exchanges.
    3. 3. Links to sites offering the same merchandise for cash, or for the same or lower price.

    The links described above are not permitted and will be deleted.

    V. Tax Policy

    A Trade may be treated as a taxable event for the purposes of income tax and the obligation to declare, report and account for all income tax purposes resulting from the Trades rests with Members and/or Merchants participating in the Trade Transaction. Each Member and/or Merchant hereby indemnifies TrumerX in respect of any penalty charge or cost which may be imposed or incurred in respect of any failure to comply with income tax laws, in respect of any Trade in which the Member and/or Merchant participates. Members and/or Merchants acknowledge and agree that TrumerX may be required, from time to time, to make disclosure to Inland Revenue Board in relation to Trades. TrumerX is authorised to provide any information to, and to co-operate at any way with such authorities, in such manner in their absolute discretion, and whether or not TrumerX is obliged by law to furnish such information or to provide such co-operation. TrumerX shall not be liable to any Member and/or Merchant in respect of information furnished to, or co-operation with, such authorities, in any circumstances whatsoever.

    VI. Restricted Items Policy
    Members and/or Merchants are responsible for making sure that selling their inventory is (1) not prohibited by law and (2) is allowed on TrumerX or its website.

    The following guidelines will help in properly listing items and understanding what is allowed on TrumerX or its website.

    1. "Prohibited" means that these inventory items may not be listed, bought or sold on TrumerX.

    • Copyrighted materials without the written authorization from the copyright owner
    • Counterfeit and illegally duplicated items
    • Drugs and drug paraphernalia
    • Embargoed items
    • Firearms
    • Government IDs and licenses
    • Human parts and remains
    • Prescription drugs/materials
    • Stocks and other securities

    Important note: Even if Member and/or Merchant offer to give items for "free" (rather than sell) a prohibited, questionable, or infringing inventory item, this will not relieve Member and/or Merchant of potential liability. This applies to both seller and buyer.

    This list is updated from time to time and is incorporated by reference into the Client Agreement. Notice of updates to this list will be posted on the Announcement Board on TrumerX on the day of the change.

    These guidelines do not constitute legal advice and do not pertain to any particular company's practices. When in doubt, check with law enforcement agencies, a lawyer, the law or with a copyright, trademark or other rights owner for clarification. TrumerX also has adopted certain policies regarding prohibited items, regardless of the legality of the item. As stated in the Client Agreement, Members and/or Merchants must agree to hold TrumerX harmless from and against any and all claims arising out of the violation of any law or violation or infringement of the rights of any third party as a result of listing products and services on the TrumerX.


    VII. Current TrumerX Programs

    Notwithstanding the Transaction Fees And Policy stated in II herewith, the Current TrumerX Programs, as at 21st June 2022, shall be applicable. Any changes to the Current TrumerX Programs shall be effective after 10 Business Days once it is posted on the TrumerX website.

    Buyers (Trumer Members and Merchants)
    All buyers using RM for their transactions will be rewarded with the RM Incentive Program

    Sellers (Trumer Merchants)
    TRM to be credited to Trumer Merchant: 4%
    RM to be credited to Trumer Merchant: 90%

    Sellers (Trumer Members)
    TRM to be credited to Trumer Member: 4%
    RM to be credited to Trumer Member: 90%

    RM is used to record the value of goods and services transacted in the local currency between the buyer and seller. The value of the local currency is as per the table 'RM and Value of Local Currency' as determined and displayed by TrumerX at the time of the transaction.The numerical value of TRM is determined by the similar numerical value of RM. The buyer will not be subjected to any fees. The policy of crediting and paying the seller shall be:
    When RM is transacted, the amount of local currency paid by the buyer as received by TrumerX and the equivalent RM, less fees or charges due to TrumerX from any Member and/or Merchant in accordance with the terms and conditions of this Agreement, is credited to the seller as a pending RM balance. This pending balance cannot be used for any transactions within TrumerX. The pending RM balance will then be credited to the bank account of the seller in the local currency within the stipulated time given in this Agreement by TrumerX and the equivalent amount of the local currency to be credited to the bank account will be as determined and displayed by TrumerX as per the table 'RM and Value of Local Currency' at the time of the transaction.

    Transfer of TRM
    Only verified Trumer Members/Merchants are allowed to perform transfer of TRM.
    For transfer of TRM between Members/Merchants to be approved by TrumerX, Members/Merchants must have a minimum balance of TRM5 remaining in their TrumerX account upon transfer.
    Should Members/Merchants not meet the transfer requirements, TrumerX reserves the right to reject the transfer request.

    2. TrumerPay
    Trumer Pay has now enabled members to carry out transactions using TRM and/or RM. This is done for the convenience of members who do not have enough TRM. In the event where members do not have enough TRM, members are able to complete their purchases or make their balance payment either through cash paid directly to the merchants, or via the payment gateway provided.
    The amount of TRM you have in your account is displayed on the TrumerX App. Should you not have enough TRM required to complete the transaction, you can either:
    1. Use the amount of TRM that you have and pay the balance in cash to the merchant.
    2. Complete balance payment via payment gateway (Using Online Banking Via FPX) provided, by exchanging your RM for TRM and then complete the transaction using TRM.
    For 1. above, when you make balance payment that is paid in cash directly to the merchants, no rewards will be given.
    For 2. above, when you make balance payment in RM via the payment gateway provided, you will be rewarded with up to 15% TRM of the amount that you exchange the RM (ie, you exchange RM100, you will be credited 515TRM)(until further notice) for TRM to complete the payment, terms and conditions will apply.

    3. RM Incentive Program
    Members who use RM to transact on the TrumerX platform will also be rewarded with 5% TRM. As an introductory offer, Trumer is rewarding Members with up to 3 times of the 5% TRM, making that a total of up to 15% TRM(ie, you exchange RM100 using Online Banking via FPX Platform, you will be credited 515TRM) (until further notice). Members can make use of the rewarded TRM, which has no expiry date, for various transaction purposes at any time.

    4. Trumer Reward Program (TRP)
    The Trumer Reward Program is now amended as follows:
    Upon activation of account, via the link sent to the members’ hand phone, 10TRM will be credited to the members account.

    5. Merchant Incentive Program
    This is not applicable. This has been replaced by the relevant transaction fees charged.

    6. Additional Terms and Conditions For Merchants Only

    A processing fee of RM100.00 is payable upon registration.

    8. Car Pooling Coordination Services

    Fees Chargeable: For a promotional period from now until further notice, TrumerX will be charging for this service as follows: TrumerX will deduct the transaction amount payable by the Passenger to the Driver by 6%. 94% of the payable amount by the Passenger will be credited to the Driver as per the terms and conditions herewith.
